More recently in 2008 and 2014, the Designs Rules have been amended further. The former lenient view with regard to novelty and validity has been considerably tightened and the same absolutely novelty provisions which have existed for years with respect to patents, are now applicable with respect to designs as well.
The jurisdiction for designs is Kolkata but significantly an applicant may at his convenience or in an emergency place on file an application for registration in any of the branches of the Patent Office around India and the date of filing his application at the branch will be the official date accorded to the case.
